FORCE MAJEURE
https://jothemedium.com.au will not accept any responsibility or liability in regards to failure to perform its obligation, including obligations cited under these terms of Use, caused by Force Majeure i.e. external forces beyond our control, which include but are not limited to terrorism, natural disasters, strikes or, electricity failures.
WHOLE AGREEMENT
These terms and conditions represent the whole agreement between you and Jo The Medium concerning your use and access to Jo The Medium’s website and your use and access to the documents and information on it. No other term is to be included in this agreement except where it is required to be included by any legislation of the Commonwealth of Australia or any State or Territory. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.
EXCLUSION OF UNENFORCEABLE TERMS
Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be
deemed never to have been included in these terms and conditions in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.
GENERAL
Verbal abuse, emotional abuse, bullying, or excessive negative behaviour, will not be tolerated on our services. If you display such behaviour, at our discretion, we may use whatever means are available to restrict access our services.
POSTAGE
Shipping costs can change from time to time without notice due to rising shipping and transport costs.
RETURNS & REFUNDS
We are not required to provide a refund or replacement if you change your mind. But you can choose a refund or exchange if an item has a major problem. This is when the item:
· has a problem that would have stopped someone from buying the item if they had known about it
· is unsafe
· is significantly different from the sample or description
· Alternatively, you can choose to keep the item and we will compensate you for any drop in value. If the problem is not major, we will repair the item within a reasonable time. If it is not repaired in a reasonable time you can choose a refund or replacement. Please keep your proof of purchase—e.g. your receipt.
CRYSTALS
Crystals have been used spiritually for many years for spiritual purposes. Any information regarding the spiritual use of crystals should NOT be used to replace any medical advice. Please consult your doctor for medical advice on any psychological or medical condition. Anyone with any kind of medical condition should always seek medical advice from a qualified medical practitioner.
CANCELATION POLICY
We understand that sometimes, unexpected delays can occur making schedule adjustments. If you need to cancel your appointment, we respectfully request at least 24hrs notice. No-shows, late arrivals, and cancellations inconvenience not only Jo The Medium but our other clients as well. When you book your appointment, you are holding a space on the calendar that is no longer available to other clients. In order to be respectful of your fellow clients, please contact Jo The Medium via email jo_themedium@outlook.com as soon as you know you will not be able to make your appointment.
If cancellation is necessary, we require that you email at least 24 hours in advance. Appointments are in high demand, and your advanced notice will allow another client access to that appointment time.
Please be aware of the policy regarding missed appointments.
Cancellation, Late, No-Show Policy:
· All No-Show appointments will be charged the full fee of your appointment
· Any cancellation or reschedule made less than 24 hours may result in a cancellation fee. The amount of the fee will be 50% for all services.
· If you are more than 15mins late for your service, I will do my best to accommodate you in the remaining appointment time, however depending on the service I may not be able to accommodate you and may result in an automatic cancellation. In this case, the same cancellation fee will apply.
